Terms of service

1. Agreement

These terms are an agreement between you and Skirmish Sales Technology Inc. (“we”, “us”) for your use of Wisp. By using Wisp you agree to them. If you use Wisp for an organization, you confirm you are authorized to accept these terms for it.

2. Your account

You are responsible for your account, the activity in your workspace, and keeping your sign-in secure. Tell us promptly through our contact form if you suspect unauthorized use.

3. Your content and responsibilities

You keep ownership of the content you add to Wisp and give us permission to use it only to provide the service. You are responsible for your content and for the messages you approve and send, and you must have the right to use the contact information you add. You agree to follow applicable laws, including laws on commercial messages, consent, privacy and anti-spam, and the rules of any account you connect.

4. Acceptable use

Don’t use Wisp to send unlawful, deceptive or harassing messages, to contact people who have opted out, to infringe others’ rights, to interfere with or probe the service, or to copy or reverse engineer it.

5. Fees

Paid plans are billed as described at purchase. Fees are non-refundable except where required by law. We may change fees with advance notice.

6. Suspension and termination

You may stop using Wisp at any time. We may suspend or end access if you breach these terms or to protect the service or others. After termination we delete your data as described in our privacy policy.

7. Disclaimers

Wisp is provided “as is” and “as available”, without warranties of any kind, to the extent permitted by law. Research and suggested drafts may be inaccurate; review them before relying on them.

8. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or lost profits or data, and our total liability is limited to the amount you paid us in the twelve months before the claim.

9. Indemnity

You will defend and indemnify us against claims arising from your content, the messages you send, or your breach of these terms or the law.

10. Changes

We may update these terms. We will post the updated version here and, for material changes, give reasonable notice. Continuing to use Wisp means you accept the updated terms.

11. Governing law

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules.
